Welcome to LookAtMe. These Terms and Conditions ("Terms") govern your access to and use of LookAtMe's SaaS platform, web console, Windows fleet monitoring agents, telemetry gateways, APIs, and associated services (collectively, the "Service"). By registering an account, deploying the agent software, or accessing the Service, you ("Customer", "Organization", or "User") agree to be legally bound by these Terms.

1. Account Registration & Organization Administration

1.1. Eligibility: You must represent a legally recognized business entity or organization and possess authority to enter into these Terms on behalf of that entity.
1.2. Single-Step Credentials: Access requires valid single-step JWT credential authentication. You are strictly responsible for maintaining the confidentiality of your administrative credentials and API keys.
1.3. Tenant Administration: The primary organization account holder ("Tenant Admin") maintains full responsibility for configuring sub-accounts, role-based access control (RBAC), monitoring policies, and employee enrollment.

2. Authorized Use of Endpoint Monitoring Software (EMS)

2.1. Ownership & Notice Requirement: LookAtMe provides deep workstation telemetry (Active window focus, biometric keystroke cadences, clipboard inspection, USB audit, and remote management). You warrant and represent that:

You exclusively install the LookAtMe Windows Agent on employer-owned, leased, or explicitly authorized organizational computing devices.
You comply with all applicable local, national, and international labor laws, including providing transparent privacy notices to employees as required under GDPR Article 88, state wiretapping laws, and workplace surveillance statutes. 2.2. Prohibited Activities: You may not:
Reverse-engineer, decompile, or disassemble any portion of the LookAtMe Agent binaries or backend APIs.
Utilize the Service for unlawful surveillance, stalking, interception of consumer data outside the scope of employment, or unauthorized covert monitoring.
Bypass or attempt to defeat tenant isolation barriers, encryption keys, or rate limits.

3. Subscription Plans, Billing & SLA

3.1. Subscription Tiers: Access is granted based on your active subscription tier (Free, Starter, Professional, Enterprise Demo) governing enrolled device caps, cloud storage limits, and advanced module entitlements.
3.2. Uptime & Service Level Agreement (SLA): We commit to a 99.9% uptime target for our Multi-Region Gateway and API services, backed by automated BullMQ multi-cloud disaster recovery architectures.
3.3. Payment & Renewals: Subscription fees are billed in advance on recurring cycles. Failure to renew may result in temporary suspension of agent telemetry ingestion.

4. Intellectual Property

4.1. Platform IP: LookAtMe Technologies Inc. retains all intellectual property rights, trademarks, patents, and proprietary software logic.
4.2. Customer Data Ownership: The Customer retains 100% ownership and copyright over all telemetry data, employee records, documents, CRM records, and business workflows ingested into the platform.

5. Termination & Suspension

We reserve the right to suspend or terminate accounts that violate our Acceptable Use Policy, engage in unauthorized surveillance, or attempt to compromise platform security. Upon termination, Customer data will be handled in accordance with our Data Retention & Deletion Policy.

6. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any legal disputes shall be submitted to binding commercial arbitration.
